We believe that the District Court's decision to declare the case as corum nobis is correct because new evidence emerged that would have triggered a different sentence for Korematsu. Additionally, and despite the fact that he has already paid a large part of the sentence that had been granted to him, the District Court recognizes that there is still time to modify said sentence and that he can go free because he was not guilty.
